This Membership / Guest Agreement (“Agreement”) is between Toe 2 Toe Boxing, LLC and the participant and/or participant’s legal guardian (“Participant”) as noted in signature area.  The parties agree to be bound by all claims, terms, and conditions of this Agreement. This Agreement is a legally binding obligation between the parties.

1. RELEASE OF LIABILITY AND ASSUMPTION OF RISK

1.1. Equipment. Toe 2 Toe Boxing, LLC does not manufacture any fitness equipment located at the Facility. I release and forever discharge Toe 2 Toe Boxing. LLC from any and all claims, demands, injuries, damages, or causes of action arising from my use of any such equipment.

1.2 Facility. In the event the Facility is unsupervised, and no employee is on site to provide me assistance in using any equipment, I release and forever discharge Toe 2 Toe Boxing, LLC from any and all claims, demands, injuries, damages, or causes of action arising from my use of the Facility.

1.3 Assumption of Risk. I acknowledge that by signing this Agreement, I assume all risks of injury or death, including, but not limited to, injury caused from use of weights, equipment, facilities, programs, or classes. I use the facilities, equipment, and amenities at my own risk.

1.4 Release of Liability. I understand and agree that my use of this Facility involves the risk of injury to me, whether or not caused by me. I understand that these risks can range from minor to major injuries, including death. In consideration of my participation in the activities and use of the Facility, I understand and voluntarily accept this risk and release, acquit, and forever discharge Toe 2 Toe Boxing, LLC, its guests, employees, agents, and independent contractors from any and all claims, demands, damages, costs, expenses, loss of services, actions or causes of action, or demands of any kind or nature for any injury, including, without limitation, personal, bodily, or mental injury, economic loss, death, or any damage to me, my spouse, domestic partner, guest, unborn child/ren, or relatives, resulting from my use of the Facility, the activities, or the negligent, reckless, or intentional conduct of Toe 2 Toe Boxing, LLC.

1.5 Medical Emergencies. In the event of a medical emergency, or believed medical emergency, involving me, I hereby authorize Toe 2 Toe Boxing, LLC to call for and obtain emergency medical services on my, and at my sole cost and expense. I agree to protect, indemnify, and reimburse Toe 2 Toe Boxing, LLC for all such emergency medical expenses. I authorize Toe 2 Toe Boxing, LLC and its employees, agents, and independent contractors to provide emergency first aid in the event of a medical emergency, uncontrolled bleeding, broken bones, or unconsciousness.

2. REPRESENTATION OF GUEST. I understand that there are inherent risks associated with attending a gym and undertaking any exercise or fitness routine. I represent that I am in good physical health and physically able to participate in and/or undertake an exercise or fitness routine and I have consulted with my own physician about the advisability of undertaking such a routine

3. RULES AND REGULATIONS. I agree to be bound by the Rules and Regulations posted at the Facility, no matter if I am a member, or a guest, at Toe 2 Toe Boxing, LLC.  Toe 2 Toe Boxing, LLC has the right to remove me from the Facility at any time for failure to abide by the Rules and Regulations posted at the Facility or for any other reason.

4. Toe 2 Toe Boxing, LLC IS NOT RESPONSIBLE FOR LOST, STOLEN, OR DAMAGED PERSONAL PROPERTY. I SHOULD NOT BRING VALUABLE ITEMS INTO THE FACILITY.

5. EQUIPMENT DAMAGE. I am liable to Toe 2 Toe Boxing, LLC for any equipment damage caused by me and I will immediately reimburse Toe 2 Toe Boxing, LLC for any damage I cause to the equipment, and/or to the Facility.

6. COMPLETE AGREEMENT. I acknowledge that this Agreement and the Gym Rules and Regulations I received with this Agreement and posted at the Facility contain the entire agreement between me and Toe 2 Toe Boxing, LLC, and no oral promises or other statements or terms are part of this Agreement.

COVID-19 Clause: As we re-open the gym, we are committed to providing our teams and members with a clean and safe environment. In doing so, we need your help. Below are a few guidelines that we ask you to accept and follow when you visit the Facility. For good and valuable consideration, the parties agree as follows:

1. HEALTH & SAFETY

I confirm I do not have any symptoms related to and have not been knowingly exposed to COVID-19. If the above status changes, I agree not to visit the Facility.

2. FACE COVERING

We strongly recommend members wear masks while in the Facility.

3. SOCIAL DISTANCING

I agree to keep 6 feet between myself and other members while in the Facility.

4. CLEANLINESS

I agree to disinfect all equipment after use and will not enter closed-off areas. I agree to keep my hands washed/sanitized while at the Facility.

I HAVE READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTAND ITS CONTENTS AND VOLUNTARILY AGREE TO ITS TERMS AND I ACKNOWLEDGE RECEIPT OF THE RULES AND REGULATION

Terms and Conditions / House Rules

1. Have fun!  That’s what this place is all about
2. If you miss class there is no make-up option.   
3. Have your hands wrapped and ready when class starts
4. We encourage videos and pictures, and we will be doing the same for our social media outlet.  Posting on social media helps us and lets people know you are putting in the work.  Please tag us when possible and let us know if you do not want any video or pictures of you, or your child, on our social media outlets / website. 
5. Lead by example!  Your kids, friends and family are watching YOU, so show them what it takes
6. Be helpful.  Be kind.  Be respectful. 
7. Drink water.  Water is your friend, and we don’t drink enough of it
8. Music will be age appropriate and will be played at all times and sometimes very loud.  Adult classes will have music with bad words. 
9. Any issues, questions or concerns at all, bring them up to me right away.  I am sure we can work it out. 
10. We are small and work hard to do our best at all times.  Please be patient with us and bring anything and everything to our attention.  Not everything will go perfect all the time, so we ask that you adapt and be nimble with us.  We will always do what we can to make things right. 

About Toe 2 Toe Boxing

I opened this gym so that I could introduce people to the sport I love, Boxing.  There are no judgements here!   No need to be intimidated when you walk in these doors because every workout is for you to better yourself, not impress someone else.  We all have different goals in life and in health, so while you are here, work on making yourself better.
